These Terms of Service govern your use of the Zoomshop marketing website at zoomshop.com. Use of the Zoomshop platform itself is governed by a separate Master Services Agreement executed with each dealership customer.
1. Acceptance
By using zoomshop.com, you agree to these terms. If you don't agree, don't use the site.
2. What zoomshop.com is
zoomshop.com is a marketing site describing the Zoomshop dealer platform. It's not a self-service tool — you can request a demo or audit, but the platform itself is provisioned by our team after a signed agreement.
3. Acceptable use
You agree not to:
- Attempt to disrupt, scrape, or reverse-engineer the site.
- Use the site to send unsolicited communications ("spam").
- Submit false information through our forms.
- Infringe our or anyone else's intellectual property.
- Violate any law with your use.
4. Intellectual property
All content on zoomshop.com — text, code, designs, product imagery — is owned by Gorilla Public or its licensors and protected by copyright and trademark law. You may not reproduce or use it without written permission, other than viewing it in your browser and sharing individual page links.
"Zoomshop" and the Zoomshop mark are trademarks of Gorilla Public. Manufacturer names (Lexus, BMW, Kia, etc.) referenced on the site are trademarks of their respective owners and are shown only to identify prior work; no endorsement is implied.
5. Third-party sites and links
Zoomshop.com may link to third-party websites (e.g. demo.zoomshop.com, partner press kits, integration vendors). We don't control those sites and aren't responsible for their content or practices.
6. Disclaimers
The site is provided "as is" without warranties of any kind, express or implied. Content on the site is for general information — pricing, availability, and product features may change. Statements about accessibility law, CCPA, or state disclosure requirements are not legal advice; consult your own counsel.
7. Limitation of liability
To the maximum extent permitted by law, Gorilla Public and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of zoomshop.com. Our total liability for any claim related to the site will not exceed one hundred dollars ($100).
8. Indemnification
You agree to indemnify Gorilla Public against claims arising from your violation of these terms or misuse of the site.
9. Termination
We may suspend or terminate your access to zoomshop.com at any time, with or without cause. Sections 4, 6, 7, 8, and 10 survive termination.
10. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Calaveras County, California.
11. Changes
We may update these terms from time to time by posting the updated version here. Continued use after changes means you accept them.
